How can I register in a new rented flat?

The procedure for registering in a property is quite simple, and should not cause you any problems. However, as with all procedures that have to be formalised with the administration, it is advisable to follow the appropriate guidelines.

In fact, many people consider that it is not necessary to register in a rented flat. Even so, not doing so can make it difficult for you to access possible rental-related benefits, as well as not enjoying other advantages, such as having health care at the nearest medical centre, registering your children in an educational centre, or going to vote near your home.

In this post, we will answer some of the most common questions about how to register in a new rented flat.

First of all, when asked the question: Is it compulsory to register in a rented flat?
The answer is yes. According to Law 4/1996, of 10 January, which regulates the Bases of the Local Regime, citizens are obliged to register in the census of the municipality in which they live.

If you live in several municipalities, or in several addresses within the same municipality, you will have to register only in the one where you live the longest during the year

The requirements for registering in a rented flat are almost the same as those established for a rented flat. If you have rented a flat, instead of presenting the title deed of the flat, you will have to bring the rental contract. This document will be enough to prove that you live in the flat in question and that, therefore, you have the right to register in it.

If your name does not appear on the rental contract, you can still register as a resident, as most town halls will arrange a visit to your home or ask you for some kind of complementary documentation to prove that you live in the property.

In addition, to register your children, in the same way as the rental contract and the rest of the documentation, you will need to present the Libro de Familia (Family Book).

To apply for census registration, you only need to provide the following documentation:

  • Application form for census registration
  • DNI, passport or residence card (you must present the original and a photocopy)
  • Libro de Familia (in the event that you want to register your children)
  • Rental contract (original and photocopy).
